Australian small business

We are a small business operating in Brisbane as an online store and ship with Australia Post which means we are required to abide by the Australian Consumer Laws. This means retailers that operate in states (Queensland, New South Wales, Victoria, Western Australia, South Australia and Tasmania) and territories (Northern Territory and Australian Capital Territory) must abide by Australian Consumer Laws.

Thousands of our customers are from New Zealand, the United States and the United Kingdom and we will also honour our standards to our international customers. 

What does this mean if you purchase from Subtly Anxious?

If you are in Australia and purchase from us, you (the consumer) will have rights under the Australian Consumer Laws. Most products and services purchased in Australia come with automatic consumer guarantees that the product or service you purchased will work and do what you asked for. This includes jewellery.

Jewellery purchased in Australia must be of ‘acceptable quality’ when you buy it, including:

  • fit for purpose 
  • look acceptable
  • free from defects
  • safe
  • durable

You must also follow care instructions, as you would any other jewellery. Please note that quality of our jewellery is not covered for wear and tear or wear outside of the care instructions on our website. 

Our warranty does not cover:

  • any stones or crystals falling off outside of three months of purchase date
  • fading or discolouring of the gold or rose gold plated jewellery outside of three months of purchase date 
  • scratches or breakage caused by extensive readjusting of the ring 

Consumer guarantees

Under Australian Consumer Law, retailers must provide these automatic guarantees regardless of any other warranties they give or sell you. If a business fails to deliver any of these guarantees, you have the right to a repair, exchange or refund.

When you receive our product and it is defective, damaged or not the same product that you ordered, we will work with you to ensure you get what you paid for.

Sales practices

Under Australian Consumer Law, retailers must not engage in misleading or deceptive conduct.

We will not make claims that our products are THE solution to your anxiety, and that anxiety rings will provide anxiety relief or stress relief, claim to be Australia’s favourite or claim to be the best anxiety rings or fidget rings in Australia - we simply can’t prove this.

We will also not claim that our anxiety rings or fidget rings are loved by thousands of Australians, when there is no evidence of this. Our verified reviews speak for themselves! 

Jewellery is not waterproof - we will not make claims that jewellery is waterproof. Our jewellery is water-resistant and we do not recommend wearing them outside of the care instructions. No matter how pure the precious metal is, frequent contact with water will eventually react to the jewellery.

This also means that we cannot claim for our jewellery to be tarnish-free. It is however, tarnish resistant, and will not rust. 

We are Australian based and have unique designs! 
Being Australian small business owners means that our sales practices must comply with Australian consumer laws - we are not selling or dropshipping products through these online stores mass produce like Amazon.com, Temu.com or Etsy where these businesses don’t need to comply with Australian consumer laws.
